Yes. You are still legally allowed to sell your property while tenants are living in it.  However, you can no longer ask them to leave under a "no fault" Section 21 notice which was banned from 1st May 2026. You now need to have a legally approved reason under Section 8.

You must now use Ground 1A of Section 8, which is a mandatory ground for evicting tenants and gaining possession when a landlord intends to sell.   You can legally bypass Section 8 by selling with 'tenants in situ' to another investor who takes over the existing tenancy.

No. You cannot use Ground 1A to evict a tenant within the first 12 months of their tenancy start date.   You can sell tenanted at any time during a tenancy.

There is a "restricted period" that begins when the Section 8 notice is served and ends 12 months after the notice expires.  During this time, you must not re-let or market the property for rent. If you do you could face fines of up to £40,000, a custodial sentence, and a total ban from acting as a landlord. This is to prevent landlords falsely issuing a Section 8 stating an intention to sell when the intent is to evict a tenant and re-let. If you advertise to sell tenanted and don't sell, or decide to withdraw your property from sale, there is no risk of a restricted letting period ban.

Misusing possession grounds or marketing a property during a restricted period can lead to civil penalties of up to £7,000 to £40,000, and potentially criminal sanctions.

To successfully use Ground 1A, you must have complied with all procedural requirements, including:   Deposit Protection: The deposit must be protected in a government-approved scheme, and prescribed information must have been served.   Safety Certificates: You must have provided the tenant with valid Gas Safety and Electrical Installation Condition Reports (EICR).   Government Guides: The current version of the "How to Rent" guide must have been provided at the start of the tenancy. Note: If any one of these procedures hasn't been completed - or even completed at the wrong time - the Court can 'strike out' the notice, allow the tenant to stay, and issue a fine.

Selling with "tenants in situ" is the fastest and simplest way. Selling to another landlord effectively bypasses the new eviction restrictions and allows your tenants to stay in their home. It's a 'win win' for you, your tenants, and the new landlord who gets immediate rental income and ROI. The new owner simply inherits the existing tenancy, and you avoid waiting for the four-month notice period, potentially long court backlogs, or the five months or more it takes to sell and complete a vacant property sale on the open market.
